Illegal content notification — FerrGrowth

FerrGrowth is a hosting provider (hébergeur) within the meaning of article 6 of the French LCEN (loi pour la confiance dans l'économie numérique) for the websites created by its users on the platform. If you believe that a website hosted by FerrGrowth contains manifestly illegal content (copyright or trademark infringement, defamation, child sexual abuse material, glorification of terrorism, incitement to hatred, etc.), you can notify us.

Valid notification format (LCEN art. 6-I-5)

For a notification to be admissible, it must include all of the following:

  1. Date of the notification
  2. Identity of the notifier:
    • Natural person: surname, first name, profession, address, nationality, date and place of birth
    • Legal entity: legal form, name, registered office, identity of the legal representative
  3. Description of the disputed content: precise URL(s), screenshots if possible
  4. Legal grounds: applicable law, rights infringed, relevant case-law references
  5. Copy of the prior notice sent to the publisher of the website (the FerrGrowth customer) requesting removal, OR a substantiated explanation of why the publisher could not be identified or contacted

An incomplete notification may be rejected as inadmissible.

Processing time

We acknowledge receipt within 48 hours. Admissible notifications are processed within 24 to 72 hours depending on severity. If content is removed, the publisher is informed in accordance with LCEN art. 6-I-5.

Abusive notification

Any notification that is manifestly abusive — i.e. submitted while the targeted content is not actually illegal — engages the civil and criminal liability of its author. Article 6-I-4 of the LCEN punishes this practice with one year of imprisonment and a EUR 15,000 fine.

Retention of notifications

All notifications received, their handling and the identity of the notifier are retained for the duration of the public-action limitation period applicable to the offence at stake, and for a minimum of one year, in accordance with our LCEN obligations.
