1. Definitions
- "FerrGrowth": the website hosting and creation service edited by Bryan Ferrando — Entrepreneur individuel (FerrLabs), SIREN 104 243 951, accessible at ferrgrowth.com.
- "Customer": any natural person of legal age or legal entity having subscribed to a FerrGrowth Subscription.
- "Hosted Site": any website created, edited or published by the Customer through FerrGrowth, hosted on servers subcontracted to OVH SAS.
- "Content": any text, image, video, code or data published by the Customer through the Service.
- "Subscription": the pricing plan (Free, Pro, Team or Enterprise) subscribed to by the Customer.
2. Acceptance
Use of the Service implies unreserved acceptance of these terms. The Customer acknowledges having read and accepted them prior to any subscription.
3. Service description
FerrGrowth provides:
- A visual website editor
- Hosting and delivery of Hosted Sites on a
*.ferrgrowth.appsubdomain or a custom domain provided by the Customer - Complementary tools: forms, A/B testing, analytics, SEO optimization
4. Pricing and subscription
Current pricing is published at ferrgrowth.com/pricing. The Service is offered in four tiers:
- Free: one site,
*.ferrgrowth.appsubdomain, ~10,000 visits/month - Pro / Team / Enterprise: increasing volumes of sites, visits, bandwidth, and advanced features
Beyond the subscribed tier, additional consumption fees may apply (visits, bandwidth) according to the published price schedule.
5. Payment
Payments are made through Stripe Inc. (United States, Data Privacy Framework certified), by credit card or SEPA direct debit. The Customer expressly authorizes monthly automatic debit. Each invoice is issued on the subscription anniversary date.
6. Term, renewal and termination
The Subscription is concluded without commitment, and is tacitly renewed each month on the anniversary date. The Customer can terminate at any time from their account area (termination takes effect at the end of the current billing period). No pro-rata refund.
In accordance with the French law of 16 August 2022, termination is accessible by means at least as simple as subscription.
7. Right of withdrawal (consumers only)
In accordance with article L.221-18 of the French Consumer Code, a Customer who is a consumer has a 14-day period to exercise their right of withdrawal. The Customer expressly waives this right by requesting immediate execution of the Service upon subscription. This waiver is materialized by the checkbox at payment time.
8. Customer obligations
The Customer warrants that the Content published:
- Does not infringe any intellectual property right
- Is not defamatory, abusive or contrary to public order
- Does not incite hatred, violence, or discrimination
- Does not contain child sexual abuse material, terrorist content, or content illegal under French law
- Complies with the GDPR for the personal data processed via the Hosted Sites
- Has the necessary authorizations (legal notice, privacy policy, cookies, etc.)
The Customer is solely responsible for the Content published. They undertake to indemnify FerrGrowth against any claim, judgment, or defense costs related to non-compliant Content.
9. Hosting and liability (LCEN)
FerrGrowth acts as a hosting provider within the meaning of article 6 of the French LCEN. As such:
- FerrGrowth does not control a priori the Content published by the Customer
- FerrGrowth cannot be held liable for the Content, except where it has had knowledge of it and has not acted promptly to remove it
- Any notification of illegal content can be sent according to the procedure published at ferrgrowth.com/abuse
- In case of admissible notification, FerrGrowth will remove the disputed Content within 24 to 72 hours and will inform the Customer
FerrGrowth retains the Customer's identification data and connection logs for a minimum of one year (LCEN art. 6-II).
10. Suspension and termination for cause
FerrGrowth may suspend or terminate the Subscription, without notice or refund, in case of:
- Manifestly illegal Content notified and not removed
- Payment default of more than 15 days
- Serious breach of these terms
- Attempted attack on the infrastructure (abuse, spam, fraud)
11. Personal data
The Customer's data is processed in accordance with the privacy policy published at ferrgrowth.com/privacy. FerrGrowth is the data controller for Customer account data. The Customer is the data controller for personal data collected via their Hosted Sites; FerrGrowth is the processor within the meaning of GDPR art. 28, and a Data Processing Addendum (DPA) is available on request.
12. Intellectual property
- The FerrGrowth source code, the "FerrLabs" and "FerrGrowth" trademarks, the visual editor and all associated graphical elements remain the exclusive property of Bryan Ferrando — Entrepreneur individuel.
- The Content published remains the property of the Customer. The Customer grants FerrGrowth a non-exclusive, worldwide, royalty-free license to host, deliver, cache and technically adapt this Content for the purposes of the Service.
13. Limitation of liability
FerrGrowth is bound by an obligation of means. FerrGrowth's liability is limited to direct foreseeable damages and shall not exceed, in any event, the amounts paid by the Customer over the past 12 months. FerrGrowth is not liable for indirect damages (loss of revenue, loss of data not backed up by the Customer, reputational harm).
FerrGrowth is not liable in case of force majeure (infrastructure subcontractor outage, DDoS attack, network unavailability).
14. Modification of terms
FerrGrowth reserves the right to modify these terms. Any modification is notified to the Customer by email at least 30 days before its entry into force. Failing express opposition by termination within this period, the new terms are deemed accepted.
15. Applicable law and jurisdiction
These terms are governed by French law. For any dispute with a professional Customer, exclusive jurisdiction of the courts of Lille.
For any dispute with a consumer Customer, in accordance with article L.612-1 of the French Consumer Code, the Customer may have free recourse to a consumer mediator. Designated mediator: [À COMPLÉTER — ex : CMAP, Médicys].
16. Final provisions
The possible nullity of a stipulation does not entail the nullity of the whole. FerrGrowth's failure to exercise a right cannot be interpreted as a waiver.
